Plan submission is a statutory duty that cannot be delegated. In making a submission, the QP appointed by the developer, is required to fulfil his/ her statutory duties to ensure the plan and submissions are prepared in accordance with regulatory requirements. Hence plan submission should not be carried out in the QPs absence.
If a QP is away for a long period and could not oversee the submission so as to fulfil the required statutory responsibility, there is a need to consider relinquishing his/ her duty to another QP with the consent of the developer.
